Terms of Service

Lead Agent is a cloud software product that helps business customers capture, qualify, and manage financing-related leads and supporting documents. Features, limits, and availability may change as described in your plan or in-product notices.

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. You must be authorized to bind your organization if you register on its behalf.

You are responsible for your relationship with applicants and other third parties whose information you collect through the service, including obtaining any required consents and providing any required privacy notices. Your use of applicant data must comply with applicable laws and regulations.

Lead Agent is subscription software for brokers. We are not a lead marketplace, data broker, or resale business that monetizes your applicant relationships for our own commercial purposes separate from providing the product. How we handle data—including lead ownership and subprocessors—is described in our Privacy Policy.

Plans and trials. We may offer a limited trial of Lead Agent with caps and rules published in the product (for example limits on captured leads or how many non-sample leads stay visible during trial). Trials are for evaluation, not a separate paid product. Paid plans, prices, and limits are described on the marketing site, at signup, or in the product—the in-product and published descriptions control if they differ from older screenshots or descriptions.

Payments. Paid subscriptions are processed by our third-party payment processor (Stripe), including hosted flows such as checkout and the Stripe Customer Portal where we enable them. You authorize us and Stripe to charge your payment method for applicable fees. Taxes may apply where required.

Fees are generally non-refundable for the billing period you paid for; access continues through the end of that paid period unless we state otherwise in writing. Failure to pay may result in suspension or termination of access.

You agree not to:

• Use the service unlawfully, fraudulently, or to harm others.
• Attempt to gain unauthorized access to the service, other accounts, or our systems.
• Reverse engineer, scrape, or overload the service except as permitted by law.
• Upload malware or content you do not have the right to use.
• Misrepresent your identity or your authority to collect information from applicants.

We retain all rights in Lead Agent, including software, branding, and documentation. You retain your own content. You grant us a limited license to host, process, and display your content as needed to provide the service.

We handle personal information as described in our Privacy Policy. You should not share service credentials or export applicant data except as permitted by law and your agreements with applicants.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT AI OR AUTOMATED OUTPUTS WILL BE ACCURATE OR COMPLETE. YOU ARE RESPONSIBLE FOR YOUR CREDIT AND COMPLIANCE DECISIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER LEND NET LLC NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), EXCEPT WHERE PROHIBITED BY LAW.

You will defend and indemnify us against third-party claims and costs arising from your content, your use of the service in violation of these Terms, or your violation of applicable law or third-party rights.

We may suspend or terminate access for breach of these Terms, risk to the service, or non-payment. You may stop using the service at any time. Provisions that by their nature should survive (including disclaimers, limitations, and indemnity) will survive termination.

These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for disputes arising out of these Terms, subject to applicable mandatory consumer protections in your jurisdiction.

We may modify these Terms by posting an updated version on this page. If a change is material, we will provide reasonable notice where required. Continued use after the effective date constitutes acceptance of the updated Terms.
